Our Services are designed for informational and professional use only and are not, under any circumstances, to be considered financial or investment advice.

Starter Plan (€22.99/month or €199.99/year): Provides 15 artworks, 15 sales intel reports, 5 valuations per month, 2 team members, verified auction database access, and team sync.
Professional Plan (€59.99/month or €499.99/year): Provides 50 artworks, 50 sales intel reports, 30 valuations per month, 5 team members, verified auction database access, and team sync.
Enterprise Plan (€149.99/month or €999.99/year): Provides 200 artworks, 200 sales intel reports, unlimited valuations, unlimited team members, verified auction database access, team sync, and priority support.
Fair Pass (€44.99/week): Provides 30 artworks, 30 sales intel reports, 15 valuations, 4 team members, and full 7-day all-access. No auto-renewal.

You acknowledge and agree that core features of our Services, including the artwork scanning, sales intelligence, sales scripts, talking points, and valuation features, are powered by artificial intelligence (AI) and machine learning algorithms. The outputs from these services are generated automatically based on vast datasets.
Key Characteristics of Our AI-Powered Services:
All content provided through the Services, including all text, graphics, logos, reports, data, software, and AI-generated content, is the exclusive property of CanvasArt Tech OÜ or its licensors. We grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your professional, non-redistributable purposes, subject to these Terms.
You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from our Services, except for:

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CANVASART TECH OÜ, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST SALES, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICES, REGARDLESS OF THE FORM OF ACTION, IS STRICTLY LIMITED TO THE TOTAL AMOUNT OF FEES YOU PAID TO US FOR YOUR SUBSCRIPTION DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
This limitation of liability is a fundamental element of the basis of the bargain between you and CanvasArt Tech OÜ.
Your use of the Art Gallery IQ mobile application is subject to the general Terms above and the following specific conditions.
AI-Generated Analysis: When you photograph an artwork using the App, the image is transmitted to our AI service provider for analysis. The resulting report, including sales intelligence, talking points, sales scripts, and valuation estimates, is generated by artificial intelligence without human review.
Image Quality: The accuracy of analysis depends on the quality of the photograph you provide. Blurry, poorly lit, or partial images may result in inaccurate or incomplete analysis.
No Authentication: The App does not authenticate artworks. AI analysis cannot verify the authenticity, origin, or authorship of any artwork. Any identification of artists or works is an AI-generated suggestion, not a definitive attribution.
Sales Scripts and Talking Points: AI-generated sales scripts, objection handlers, and talking points are suggestions to assist your professional sales activities. You are solely responsible for the accuracy and appropriateness of statements made to buyers.
Verified Data: Valuations are based on our proprietary database of verified auction records from Christie's, Sotheby's, Phillips, and other major auction houses, supplemented by web research when database matches are unavailable.
Confidence Scoring: Each valuation includes a confidence score (Low, Medium, or High) reflecting the quality and relevance of available comparable data.
Not an Appraisal: Valuations are AI-generated estimates, not professional appraisals. They should not be relied upon for insurance, sale, legal, or tax purposes without independent verification.
Feature Limits: Each subscription tier includes specific limits for artworks, sales intel reports, and valuations per billing period.
Credit Expiration: Unused credits do not roll over to the next billing period. Credits reset at the beginning of each billing cycle.
Free Tier Limitations: Free users receive a one-time allocation of 3 scan credits. Once exhausted, a subscription is required to continue using AI analysis features.
Fair Pass: The Fair Pass provides 7-day all-access. It does not auto-renew.
Local Storage: Your artwork inventory, offer history, sales data, and organisational information is stored locally on your device.
Data Loss: We are not responsible for loss of inventory or offer data due to device failure, loss, theft, app deletion, or other causes. We recommend maintaining separate records of important inventory and transaction information.
No Backup Service: The App does not currently provide cloud backup services. Data exists only on your device.
Guidance Only: The KYC/AML compliance checklists are provided for informational guidance purposes only. They do not constitute legal advice and do not guarantee compliance with any regulation. You are responsible for ensuring your own compliance with applicable anti-money-laundering laws in your jurisdiction.
Team Sync: Team synchronisation features allow multiple team members to share booth access. The account holder is responsible for all activity conducted by team members under their subscription.

The App is made available through the Apple App Store. Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms regarding the use of the App, Apple's terms shall prevail with respect to your use of the App.

Refunds: Refund requests for App subscriptions must be made through Apple. Visit reportaproblem.apple.com to request a refund from Apple.
Subscription Renewal: Monthly and annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. The Fair Pass does not auto-renew.
You agree to defend, indemnify, and hold harmless CanvasArt Tech OÜ, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
These Terms are governed by the laws of the Republic of Estonia. All disputes arising from or relating to these Terms or the Services shall be resolved exclusively by the Harju County Court in Tallinn, Estonia.
For users accessing the App through the Apple App Store, you may also have rights under the consumer protection laws of your country of residence.
We reserve the right to amend these Terms at any time by posting the revised version on the Website and/or through the App. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
